These Terms and Conditions govern the relationship, use, and all commercial transactions executed between Melonwoods (“the Company”, “we”, “us”) and the user or purchaser (“the Customer”, “you”) on this website. By accessing, browsing, or purchasing from this platform, you acknowledge that you have read, understood, and agree to be bound by these provisions without modification.

1. Product Characteristics, Artisanal Tolerances & Natural Variations

1.1 Most items showcased on this platform are available for acquisition or viewing via our physical showrooms. However, due to raw material cycles and import scheduling, certain items may have variable availability. Standard local manufacturing or personalized fabrication timelines typically require a production window of four (4) to eight (8) weeks from the point of formal cleared deposit.

1.2 Our furniture is meticulously handcrafted utilizing authentic reclaimed timber or premium solid wood profiles. The Customer explicitly acknowledges that due to the bespoke, handcrafted nature of our furniture and the organic characteristics of the raw materials used, minor variances in final product dimensions (including a standard artisanal manufacturing tolerance of up to 20mm) may occur.

1.3 Furthermore, features such as natural structural expansion or contraction, minor surface splits, organic texture differences, distinct grain patterns, structural glass characteristics, and subtle color shading variations are natural, inherent features of high-caliber timber products. These organic hallmarks and dimension variances enhance the singular, exclusive, and artisanal nature of the product; they do not constitute material defects or manufacturing failures.

1.4 For all custom items manufactured locally, standard drawer internal configurations and foundational support framing elements utilize Pine Wood. Alternative specialized timber profiles for internal structures can be quoted on an individual request basis.

1.5 While we employ premium photography and high-accuracy monitors to showcase colors, grains, and finishes accurately, the final visual rendering depends heavily on the specific color profile and calibration of your viewing hardware. We cannot guarantee your monitor display will perfectly match the physical timber piece.

2. Pricing, Availability & Order Cancellations

2.1 All prices showcased on this website are denominated in South African Rands (ZAR). Listed prices are fully inclusive of statutory Value Added Tax (VAT) at the prevailing rate, and are structured strictly on an “ex Works” (EXW) basis, thereby excluding delivery fees, packaging adjustments, or special logistical handling premiums.

2.2 The Company reserves the right to modify pricing matrices and stock availability parameters at any point without prior notice up until a transaction is formally verified by a cleared invoice payment.

2.3 Price and Availability Clause: While we maintain strict quality control mechanisms to avoid pricing or stock display errors, technical errors may occur. Melonwoods explicitly reserves the right to cancel any order, transaction, or contract of sale at our sole discretion in the event of an inadvertent pricing error, system glitch, or unexpected stock unavailability. In all such instances, Melonwoods is under no legal obligation to fulfill the transaction at the incorrect price or find alternative stock. We will cancel the order immediately and process a prompt, full refund of all monies actually cleared for that specific transaction.

3. Payment Protocols & Retention of Title

3.1 To sustain competitive price points and efficient supply lines, our standard operational payment terms require pre-payment in full prior to stock assignment or delivery booking. Once an invoice is generated, payment must clear into our designated account within 48 hours to prevent order cancellation.

3.2 The Company does not support Cash on Delivery (COD) operations.

3.3 Absolute ownership, legal title, and rights of possession concerning any product remain strictly vested in Melonwoods until the total purchase price, including any calculated delivery or logistics fees, has cleared into our bank account.

4. Delivery Preparation & Customer Obligations

4.1 It is the Customer’s sole responsibility to ensure that all ordered furniture pieces possess structural proportions that fit seamlessly into the intended space. The Customer must verify that the product dimensions allow clear passage through all entry points, doors, hallways, stairwells, lifts, and turning radiuses along the delivery route.

4.2 Any damage sustained to the furniture, property, or surroundings resulting from inaccurate space assessments or uncommunicated architectural obstacles will not be borne by Melonwoods or our designated logistics providers.

4.3 If delivery requires navigating staircases or multi-story hoisting, this constraint must be declared prior to dispatch in writing. These environments necessitate specialized equipment or additional labor, and delivery charges will be adjusted accordingly. 5. Injuries, Liabilities & Website Disclaimers

5.1 This website, its contents, and digital components are provided strictly on an “as is” and “as available” basis without any warranties of any kind, whether express, statutory, or implied. Your utilization of this digital platform is conducted entirely at your own discretion and risk.

5.2 Limitation of Liability & Injury Disclaimer: To the maximum extent permitted under applicable South African law, Melonwoods, its directors, employees, and third-party logistics agents exclude all liability for any direct, indirect, incidental, or consequential damages. This includes, without limitation, property damage, structural loss, or personal injury sustained by any individual during the transport, delivery, offloading, installation, self-assembly, or subsequent placement and day-to-day usage of heavy solid timber furniture.

5.3 It is the Customer’s strict responsibility to ensure furniture is safely positioned, anchored, or structurally stabilized where necessary (especially regarding large shelving units, heavy cabinets, or wardrobes) to prevent tipping, structural failure, or accidental injury. Where liability cannot be fully excluded by law, any actionable claim against Melonwoods will be strictly limited to remedies provided under the South African Consumer Protection Act (CPA).
